The Investigative Committee on the Allegation of Gross Misconduct Against Suspended Chairman of Chanchaga Local Government Council, Aminu Ladan has declined to restrain itself from commencement of hearing the matter while adjourning to Monday August 25, 2025.
At the inaugural hearing of the committee on Thursday, Chairman of the committee, Justice Abdullahi Mikhailu confirmed the receipt of a letter from Anthony Orifumishe, the Counsel to the respondent , Aminu Ladan raising two issues including short notice of service to appear and a pending suit before a High Court challenging his suspension and court interim order restraining further processes on the matter.
Justice Mikhailu said that the letter has been referred to the counsel to the committee for advise, assuring of justice, fair hearing and level playing ground for all parties.
In a submission, the Committee’s lead Counsel and the Director of Public Prosecution (DPP) from Niger State  Ministry of Justice, Barrister Usman Nuraini Baba confirmed that the service on the chairman was made on Wednesday evening which did not meet the 24 hours required in law.
However, he argued that the said interim order by Minna High Court restraining further action has become ineffective due to the transfer of the case to another court in Suleja, adding that, “the has to start afresh (de norvo “. He therefore urged the committee to assume hearing the matter
Ruling on the letter, Justice Abdullahi Mikhailu maintained that all pending orders in the case transferred to Suleja high court de norvo have been quashed and swept away.
He upheld the fact that the service on the suspended Chairman to from the secretary of the committee is short of 24hrs stipulated by law, adding that, “the suspended Chairman needed enough time to enable him prepare for the hearing “.
He said, ” I therefore adjourned the hearing to 25th August, 2025 for the continuation of the committee hearing”
Other members of the committee are Barrister Bala Marika and Alhaji Abubakar Salisu as members while Barrister Ibrahim Mohammed Babangida serves as the Secretary
